MUMBAI: Bombay high court on Thursday granted bail to Anuj Keshwani arrested in 2020 by the Narcotics Control Bureau (NCB) for possession of commercial quantity of drugs. He is the last of the group of accused now to be given bail.
Keshwani is one of the co-accused along with Rhea Chakrabarty, girl friend of late Bollywood actor Sushant Singh Rajput.He was allegedly found in possession of a commercial quantity of LSD, a prohibited drug under theNarcotic Drugs and Psychotropic Substances (NDPS) Act.
Justice M S Karnik granting bail said, there are in all 36 accused in the case and 35 of them, except Keshwani have been enlarged on bail. He was arrested on September 7,2020.
Based on the statement of co-accused Mohammad Kaizan Ebrahim, a raid was conducted and from Keshwani’s premises commercial quantity of charas was seized. It was 585 grams as well as over 270 grams of green leafy, small leafy buds and green leafy granules purported to be Marijuana or ganja as well as 3.6 grams of alleged THC along with 32 complete blot papers and 10 pieces of blot paper in yellow, gray and light blue colour were seized was the prosecution case argued by special public prosecutor Aruna Pai for NCB. The blot papers were weighed and found to be 0.62 grams.
There are 160 witnesses the prosecution proposes to examine said the HC. The trial is likely to take a long time to conclude, also noted the HC after hearing his lawyer Ayaz Khan.
Khan argued that bail be granted since the agency did not comply with provisions of the Narcotic Drugs and Psychotropic Substances Act during the search and alleged seizure which was done without a search warrant.
The HC said it was not considering the bail plea arguments on merits as it was following a bail order of the Supreme Court for a co-accused Jitendra Jain. The SC in it had said, “Though it is a case of commercial quantity and allegations levelled against the petitioner are serious in nature, but having regard to the fact that he is in custody for 2 years and conclusion of trial will take time, we are inclined to release the petitioner on bail.”
Special PP submitted that NCB is proposing and is in the process of challenging an order dated 04/10/2023 passed by the HC enlarging co-accused Mohammad Azam Jumman Shaikh on bail.
The HC said it was bound to follow the SC order of bail to the co-accused in the case citing time it would take for trail to get over and directed Keshwani’s release on bail for ?1 lakh surety with several bail conditions including deposit of his passport and not leaving Mumbai without trial court permission.
