NEW DELHI: The Supreme Court on Wednesday said that Chief Justice of India DY Chandrachud would decide on the listing of a plea by Trinamool Congress (TMC) leader Mahua Moitra, challenging her expulsion from the Lok Sabha.
Moitra’s urgent plea was brought before a bench comprising Justice Sanjay Kishan Kaul and Sudhanshu Dhulia. Justice Kaul informed senior advocate Abhishek Singhvi that the Chief Justice of India would make the decision.
Chief Justice Chandrachud leads a five-judge Constitution bench that convened on Wednesday to address a matter.Mahua Moitra had approached the Supreme Court, contesting her expulsion from the Lok Sabha after the ethics committee’s report, adopted by the House, found her guilty of accepting gifts and illegal gratification from a businessman.
Following a heated Lok Sabha debate on December 8, during which Moitra was denied the opportunity to speak, Parliamentary affairs minister Pralhad Joshi proposed a motion for the TMC MP’s expulsion, citing “unethical conduct.” The motion was adopted by a voice vote.
In response to her expulsion, Moitra strongly criticized the action, likening it to a verdict by a ‘kangaroo court’ and alleging that the government was weaponizing a parliamentary panel to coerce the opposition into submission.
