MUMBAI: A special PMLA court on Wednesday extended till October 4, the judicial custody of Jet Airways founder Naresh Goyal and called for a report from the jail Chief Medical Officer (CMO) by September 30 on hishealth status and issues that occurred since his remand to Arthur Road Jail. The court questioned the CMO on why the court was not informed immediately. Goyal was produced through Video Conference. He submitted that, he was facing multiple medical issues and complained that Medical Officer at the jail was not looking to his issues and submitting any report to the Court.
The ED had arrested Goyal on September 1 in a money laundering case over an alleged fraud of Rs 538 crore at the Canara Bank.
Senior counsel Aabad Ponda for Goyal, 74, pointed to medical papers and said the health of the industrialist was precarious citing his various health issues inside jail.
The special Judge in an order also called fora report of the CMO as to why these health issues were not reported to the Court immediately despite its direction to do so. “CMO shall submit his report without fail on 30.09.2023” said the order.
The court also heard special public prosecutor Sunil Gonsalves for Enforcement Directorate who sought an extension of Goyal’s JC remand.
Goyal’s lawyers submitted pleas for home cooked food along with a chart referring to health issues that occurred while in judicial custody. In his fresh plea, the Goyal said he was not getting food properly or on time and “due to less/non-consumption of food, his body is becoming weak day by day and thus suffering from imbalance in walking, severe pain in spine, joints, shoulder pain, pain behind neck, knees and ear.”
He sought orders to “be allowed to be provided with home cooked food on a daily basis while lodged in jail considering his medical conditions and deteriorating health.”
His plea for special home food filed through advocate Ameet Naik and heard by Special Judge M G Deshpande who passed the order said , “that his blood pressure has been on higher side from the day he has been arrested.” He said he “ is critically ill, and his health is deteriorating day by day due to less consumption of food as per his dietary requirements and prescribed by the doctors and thus suffers from constant vomiting due to Indigestion and Inflammation of the Gut.. is not getting food in intervals and thus is also affecting his sugar levels of the body thus making him prone to kidney failure.”
The court also has now called for a report of Jail Superintendent to state if the food provided to the accused is suitable given his health issues.
Goyal sought permission for daily medical check ups by his family physician and the court called for a “candid opinion” from the CMO on the list of ailments. The ED also has to reply to Goyal’s fresh home food and medical check up pleas.
