BENGALURU: A Bengaluru couple whose holiday to Port Blair was allegedly spoilt after their checked luggage reached two days later, sued IndiGo airlines at a city consumer court. In its verdict pronounced recently, the court ordered the carrier to pay the duo a compensation of Rs 70,000 for having caused them trouble.
Towards the end of 2021, Byappanahalli resident Surabhi Srinivas and her husband Bola Vedvyas Shenoy decided to go on a holiday to Port Blair in Andaman and Nicobar Islands. They booked tickets on IndiGo from Bengaluru to Port Blair and flew to the holiday destination on November 1, 2021. However, their checked luggage which contained clothes, medicines and ferry tickets for boat rides in the Andamans, failed to reach Port Blair. The couple lodged a complaint with IndiGo by registering a Property Irregularity Report. Following this, the ground crew of Indigo promised them that their missing bag would be delivered the very next day.
However, the baggage reached the Bengalureans only by late November 3, by which time, more than half their holiday was over. Stranded, they were even forced to buy basic items.
Claiming that IndiGo representatives knew that the luggage was not loaded on to the aircraft at Bengaluru airport, but did not reveal the information to them, Surabhi and Bola sent a legal notice to InterGlobe Aviation Limited, the operators of IndiGo airline, on November 18. A year later, they approached the Bengaluru Urban 3rd additional district consumer disputes redressal commission in Shantinagar with a complaint against the airline, demanding a compensation for spoiling their holiday.
Surabhi and Bola presented their case, while IndiGo’s attorney argued that the airline’s staff in Port Blair tried to reach them with the luggage a day after their landing, but couldn’t. The airline’s representative further noted that the ferry to Havelock Island in the Andamans had already left on November 3, making it impossible for them to deliver the luggage to the passengers on time.
In a verdict pronounced on September 26, 2023, the consumer forum concluded that IndiGo airline was responsible for playing spoilsport in what was to be a blissful and memorable Andaman holiday for the couple.
